Terms of Service

These Terms of Service (“Terms”) govern your use of the Agntfree platform operated by Agntfree LLC, a limited liability company organized under the laws of the State of California, with principal operations in Ventura County, California (“Agntfree,” “we,” “us,” or “our”).

By creating an account or using the Agntfree platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.

Agntfree is a technology platform only. We provide software tools that enable homeowners and buyers to list, discover, and transact residential real estate directly with one another.

Agntfree is not a licensed real estate broker, agent, or salesperson under California Business and Professions Code §§ 10130 et seq. or the laws of any other jurisdiction. Agntfree does not represent buyers or sellers, does not provide real estate advice, and does not participate in negotiations on behalf of any party.

MLS submission and related brokerage services are facilitated through a third-party broker of record. Agntfree is not responsible for the acts or omissions of any broker of record.

By using the platform, you acknowledge and agree that:

• You are solely responsible for all decisions made in connection with any real estate transaction, including but not limited to pricing, offer terms, inspection decisions, and closing arrangements.
• You are responsible for reviewing and understanding all contracts, disclosures, and legal documents related to your transaction. Agntfree recommends you consult a licensed real estate attorney before signing any agreement.
• You will provide accurate, complete, and non-misleading information in your listing or offer.
• You will comply with all applicable federal, state, and local laws, including fair housing laws and California disclosure requirements.
• You are at least 18 years old and legally authorized to enter into binding contracts.

Listing Fee: A flat listing fee is charged at the time of listing publication. Listing fees are non-refundable once your listing has been published and submitted to the MLS. Current fee amounts are displayed on the pricing page and are subject to change with notice.

Transaction Fee: A flat transaction fee is due at the time of closing. This fee is collected by the title/escrow company and disbursed to Agntfree via ACH at or after closing. The transaction fee is not due if a transaction does not close.

All fees are stated in U.S. dollars. Agntfree uses Stripe for payment processing. By submitting payment, you agree to Stripe’s terms of service. Agntfree does not store your full payment card details.

Nothing in these Terms, and no use of the Agntfree platform, creates or implies an agency, fiduciary, employment, joint venture, or partnership relationship between you and Agntfree.

Agntfree does not owe a fiduciary duty to any user. Users transacting on the platform are acting as principals on their own behalf.

Agntfree coordinates MLS submission through a California-licensed broker of record. Submission to CRMLS (California Regional MLS) and syndication to third-party portals (e.g., Zillow, Realtor.com, Redfin) is facilitated through that broker and typically occurs within 24–48 hours of listing publication.

Agntfree does not guarantee any specific timeline for MLS submission or portal syndication. Delays caused by MLS processing, broker availability, or third-party portal indexing are outside Agntfree’s control. Agntfree is not liable for any loss arising from delayed or failed syndication.

The Agntfree platform, including its software, design, trademarks, and content, is owned by Agntfree LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

By submitting listing content (photos, descriptions) to the platform, you grant Agntfree a non-exclusive, royalty-free license to display and distribute that content for purposes of operating the platform and facilitating your listing.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AGNTFREE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AGNTFREE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR FAILED REAL ESTATE TRANSACTIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL AGNTFREE’S TOTAL LIABILITY TO YOU EXCEED THE FEES PAID BY YOU TO AGNTFREE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Agntfree LLC and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the platform, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Ventura County, California, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. We will notify registered users by email or in-platform notice at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.
